The Superintendent will require the parent to provide all information listed in OAC 3301-34-03. 2. The Superintendent will respond to the home education request in writing and will maintain a file in the District Office containing a copy of the information supplied by the parent, a copy of the permission letter for home education granted by the Superintendent and his/her designee, papers showingV the checklist of qualifications for the home education program, copy of standardized testing results, and all other documents relating to the childs home education. 3. A student who has been suspended and/or expelled from school will not be eligible to apply for home education until the student returns to school or re-enrolls. 4. If the Superintendent refuses a parent request for home education, he/she will notify the parent of the right to a due process hearing before the Superintendent, and of the right to appeal the Superintendents decision at the due process hearing to the juvenile court of the county in which the District is located. 5. Academic assessment and remediation of home-education children should be performed in accordance with OAC 3301-34-04 and 3301-34-05.
